What is Probate Law?

Probate is a legal process that takes place after you or your loved one dies. The probate process includes legal issues that the average person isn’t prepared for.

At Davidge & Wright we have years of experience with Probate Law.

The steps that are generally encountered can be painful for a family member or loved one. We are able to guide your family or appointed official through the process.

How does the Probate Process Work?

Typically probate involves filing paperwork, managing financial directives, and some court appearances to finalize legal details.

Most people have never, or have only rarely probated a will, and many people are unaware of probate alternatives available in certain circumstances. We can assist you through the probate process.

General Probate Steps:

  • Proving in court that a deceased person’s will is valid
  • Identifying and inventorying the deceased person’s property
  • Property appraisal
  • Payment of debts and taxes
  • Distribution of the property as the will directs (or state law, if there’s no will)

What We Do:

We probate existing last wills and testaments, and we can help navigate the legal web created when a person dies without a will – otherwise known as Intestate estates. Texas has Intestate succession laws to control who inherits property if no will exists.

Davidge & Wright, L.P., also helps prepare affidavits of heirship and develop the best strategy to fairly and expeditiously probate the estate.

We will also help close and open bank accounts as needed and transfer assets to the ultimate beneficiaries.

Our Goal:

The probate process typically involves emotional stress, and all too often, familial friction. At Davidge & Wright, L.P., our goal is to relieve both of these aspects by guiding surviving spouses, children and named executors through the often confusing probate process.

Fees and Follow-up:

We have flat fee plans for most instances. We will be happy to discuss the costs associated with your specific needs for Probate Law at your convenience.
